1. About these terms
These Terms of Service govern your access to and use of the 1MARK8 website, mobile app, dashboards, listings, booking tools, payment flows, messaging, verification tools and related services operated by 1MARK8 Technologies Pvt. Ltd. By creating an account, browsing listings, buying a plan, making a booking, posting content or using any 1MARK8 feature, you agree to these terms.
1MARK8 is a technology marketplace. We help customers discover and transact with independent sellers, hosts, drivers, service professionals, merchants and other providers across Properties, Services, Stay, Trade and Commute. Unless expressly stated otherwise, 1MARK8 does not own, sell, rent, drive, host, inspect, manufacture or personally perform the underlying goods or services.
2. Eligibility and account responsibility
You must be at least 18 years old and capable of entering into a binding contract under Indian law. Business users must be authorised to bind the entity they represent.
- Keep your phone, OTP, password, device, QR login and account credentials secure.
- Provide accurate profile, KYC, business, tax, bank and listing information.
- Do not create duplicate accounts to avoid enforcement, fees, ratings or legal obligations.
- You are responsible for all activity that happens through your account unless caused solely by 1MARK8 systems.
3. Our role as a platform
1MARK8 provides discovery, subscription, booking, communication, verification, trust, support and payment-enablement tools. The contract for the actual service, stay, ride, item sale, rental, property transaction or professional work is between the customer and the relevant provider.
We may verify accounts, review listings, moderate content, facilitate support and suspend users, but these actions do not make us the employer, agent, broker, insurer, transport operator, hotelier, property owner, dealer, lender or seller of any provider.
4. Flat charges and zero commission
1MARK8 follows a flat-charge model for platform access. Providers pay the published subscription, listing, activation, verification, convenience or platform charge shown before purchase. Unless a specific product page says otherwise, we do not charge a percentage commission on the value of a transaction between a customer and a provider.
- Plan prices, inclusions, limits and billing cycles are shown on the Pricing page or checkout screen.
- GST and other applicable taxes are charged in addition to the listed plan price where required.
- Customer payments for bookings, rides, goods or services may be paid directly to the provider, through a payment partner, or through another flow shown at checkout.
- Any change to flat charges will apply prospectively. Existing paid periods continue until expiry unless the law requires otherwise.
5. Provider duties
Providers are responsible for their licenses, permits, staff, tools, vehicles, accommodation, products, insurance, safety practices, pricing, taxes, invoices, refunds for their own services, and compliance with applicable law.
- Do not publish misleading prices, fake discounts, unavailable inventory or copied photos.
- Do not ask users to move an active booking, ride, stay or sale outside 1MARK8 to evade safety checks, support records, fees or dispute handling.
- Do not collect unnecessary documents, OTPs, passwords or payment credentials from customers.
- Deliver the service, stay, ride or item substantially as described in your listing and accepted booking.
6. Customer duties
Customers must use the platform lawfully, provide accurate booking and contact details, pay applicable charges, respect provider premises and staff, and avoid abusive, unsafe or fraudulent conduct.
- Check listing details, inclusions, house rules, ride details, cancellation terms and total payable amount before confirming.
- Use OTPs only to confirm genuine pickup, check-in, delivery or service completion.
- Do not damage property, misuse vehicles, threaten providers, make false complaints or initiate chargebacks for valid completed transactions.
7. Services marketplace
For home, beauty, cleaning, repair, cooking, spa and other service bookings, independent providers perform the work. Providers must arrive within the agreed slot, carry required tools where promised, follow reasonable safety and hygiene standards, and complete the accepted scope.
Customers must give safe access to the location, disclose relevant site conditions, and not request illegal, unsafe or materially different work without updating the booking. Additional work, parts or materials may carry extra charges if accepted by the customer before completion.
8. Stay bookings
For hotels, homestays, PGs, co-living, day-use rooms, workplaces and similar stays, hosts are responsible for the property, local permissions, guest safety, photos, amenities, house rules, check-in, occupancy limits and taxes. Guests are responsible for identity information, lawful use, guest limits, property care and compliance with house rules.
1MARK8 may help with booking records and disputes, but does not guarantee the condition, legality, safety, suitability, title or uninterrupted availability of any stay unless a specific 1MARK8-operated stay product says otherwise.
9. Commute bookings
For bike taxi, auto, cab, rental, fleet or commercial commute services, rides are provided by independent drivers, fleet partners or transport providers. They are responsible for licenses, permits, vehicle fitness, insurance, route compliance, passenger safety and lawful operation.
Users must not request unsafe driving, overloaded rides, illegal goods movement or route manipulation. 1MARK8 may use OTPs, live status, support records, ratings and fraud checks to improve ride safety and accountability.
10. Trade listings
For second-hand vehicles, electronics, furniture and other goods, sellers are responsible for ownership, condition, price, lawful sale, accurate descriptions, warranties they offer, documents and delivery or handover. Buyers are responsible for inspecting goods, confirming compatibility and completing lawful payments.
- Do not list stolen goods, counterfeit products, restricted goods, illegal weapons, narcotics, recalled products, fake documents, financial scams or any item prohibited by law or 1MARK8 policy.
- Vehicle sellers must provide accurate registration, ownership, accident, loan, insurance and fitness information where applicable.
- 1MARK8 may remove listings, restrict messages or report suspicious trade activity to protect users and comply with law.
11. Listings, reviews and user content
You own the content you submit, but you grant 1MARK8 a worldwide, non-exclusive, royalty-free license to host, display, translate, moderate, promote and use that content to operate and improve the platform.
- Content must be accurate, lawful and respectful.
- Reviews must reflect genuine experiences and must not be paid, fake, threatening or defamatory.
- We may edit formatting, reject, hide or remove content that violates law, platform rules, third-party rights or user safety.
12. Payments, taxes and invoices
Payments may be processed by Razorpay or other regulated payment partners. 1MARK8 does not store full card numbers. Providers are responsible for their own customer invoices, GST, TDS, TCS, income tax and other filings unless a specific 1MARK8 product states that we will issue an invoice for platform charges only.
Failed, duplicate, reversed or disputed payments will be handled under the Refund and Cancellation Policy, payment partner rules and applicable law.
13. Cancellations, refunds and disputes
Cancellations and refunds depend on the relevant product, provider policy, timing, payment status, fraud status and applicable law. Our Refund and Cancellation Policy forms part of these terms.
For disputes, users should first raise the issue through 1MARK8 support with evidence such as photos, receipts, chat records, OTP status, trip or booking ID and payment proof. We may facilitate resolution, but we are not required to decide every private dispute unless law or a specific product policy requires it.
14. Fraud, abuse and law-enforcement cooperation
We take fraud, impersonation, safety threats, forged documents, payment abuse, fake listings, stolen goods, account takeovers, harassment, illegal services and misuse of OTP or location tools seriously.
If we reasonably suspect fraud, crime, user-safety risk, platform abuse or violation of law, we may preserve account data, device data, KYC records, listing records, booking or trip history, chats, payment references, location logs where available, IP logs, support records and related evidence. We may suspend accounts, cancel listings, withhold platform access, restrict payouts where legally permitted, and share relevant information with police, cybercrime cells, courts, regulators, payment partners, banks, insurers or affected users when required by law or when we believe in good faith that disclosure is necessary to prevent, detect or respond to unlawful or harmful activity.
15. Safety, verification and platform enforcement
Verification, badges, reviews, ranking, background checks and trust signals are risk-reduction tools, not guarantees. We may require re-verification, additional documents, live checks, professional credentials, vehicle documents, property documents, bank verification or business proof before or after allowing use of certain features.
We may warn, delist, down-rank, pause, suspend or terminate users, providers, listings or transactions if we believe there is legal, safety, trust, payment, quality or reputational risk.
16. Intellectual property
1MARK8, the 1MARK8 logo, product names, software, design, copy, graphics, data structures and platform features belong to 1MARK8 or its licensors. You may not copy, scrape, reverse engineer, resell, frame, misuse or create confusingly similar services from our platform without written permission.
17. Disclaimers and limitation of liability
The platform is provided on an as-is and as-available basis. We do not promise uninterrupted access, error-free operation, guaranteed earnings, guaranteed leads, guaranteed bookings, provider availability, property suitability, ride availability, sale completion or dispute outcomes.
To the fullest extent permitted by law, 1MARK8 will not be liable for indirect, incidental, special, punitive or consequential losses, loss of profit, loss of goodwill, personal arrangements made outside the platform, provider misconduct, customer misconduct, third-party payment failures or force majeure events. Our aggregate liability for a claim will not exceed the platform charges paid by you to 1MARK8 for the affected service in the three months before the claim, unless applicable law requires a higher amount.
18. Indemnity
You agree to defend and indemnify 1MARK8, its directors, employees and affiliates against claims, losses, penalties, damages, costs and expenses arising from your content, listings, services, goods, rides, stays, tax defaults, law violations, fraud, negligence, misconduct, breach of these terms or infringement of third-party rights.
19. Suspension and termination
You may stop using 1MARK8 at any time. We may suspend or terminate access with or without notice where required for security, fraud prevention, legal compliance, user safety, non-payment, policy violations, repeated complaints or risk to the platform. Termination does not affect accrued payment obligations, dispute records, legal rights or data retention required by law.
20. Governing law and disputes
These terms are governed by the laws of India. Subject to any mandatory consumer forum rights or statutory remedies, courts at Panchkula, Haryana will have jurisdiction over disputes relating to these terms or the platform.
21. Changes to these terms
We may update these terms to reflect new products, legal requirements, security practices or business changes. Material changes will be posted on this page and, where appropriate, notified through the app, website, email, SMS or WhatsApp. Continued use after the effective date means you accept the updated terms.
